Abstract

In the context of the exponential growth of e-commerce, this article delves into the fundamental challenges facing trademark law. Rapid digitalization and globalization have expanded opportunities for online businesses but have also intensified the need for effective intellectual property protection. From major retail platforms to small virtual stores, brand management has become essential in a digital environment marked by competition and fraudulent practices. This study aims to explore in detail the legal and practical complexities associated with brand protection in e-commerce. Online trademark registration strategies will be examined, along with methods for monitoring and legally addressing infringements. Additionally, the article will analyze how brand reputation management and consumer trust-building are crucial elements in an increasingly saturated and competitive virtual market. Through a qualitative and subjective approach, this article will not only identify the current challenges facing trademark holders in e-commerce but also propose effective strategies to address them. It is expected that this analysis will provide legal professionals, as well as businesses and organizations, with the necessary tools to protect and strengthen their brands in the dynamic and challenging world of e-commerce.
