The Impact of Climate Change on International Environmental Law: Towards a New Legal Paradigm

Abstract

In climate change is one of the most urgent challenges of our time, with impacts that affect all aspects of life globally. This article examines how this crisis is driving the evolution of international environmental law, highlighting the need for a renewed and more effective legal framework to address the new and complex challenges arising from it. Using a qualitative, exploratory, and subjective approach, the research analyzes the impact of climate change on existing international norms and treaties. It identifies the deficiencies and limitations of the current legal framework and proposes a new paradigm that incorporates principles of environmental justice, intergenerational equity, and global sustainability. This study argues that as nations and communities cope with the effects of climate change, it is crucial for international environmental law to adapt to protect human rights and ensure a livable future. In conclusion, the article underscores the need for a transformation in the conception and application of international environmental law. Only through an innovative and flexible approach, reflecting the changing realities and challenges of the 21st century, can a robust legal framework be established to mitigate the impacts of climate change and promote sustainable development globally.
