Algorithmic Justice: A Critical Evaluation of Algorithm Usage in the Judicial System

The article addresses the emergence of algorithmic justice in the digital era, where algorithms and artificial intelligence are profoundly transforming decision-making in the judicial system. It critically examines the use of these algorithms, exploring their ethical and legal implications in the administration of justice. Through a qualitative and exploratory approach, it analyzes how algorithms can affect judicial impartiality, procedural fairness, and individual rights. The study is based on emblematic cases and practical experiences to better understand how algorithms influence legal decision-making. It highlights the need to address the fundamental ethical issue of delegating human decisions to automated systems, as well as the importance of establishing legal safeguards and accountability mechanisms to ensure ethical and responsible use of algorithms in the judicial system. In a context where the use of algorithms in the judicial system is rapidly expanding, this study aims to contribute to the academic and practical debate on algorithmic justice. It provides a rigorous and reflective evaluation of how algorithms are impacting the administration of justice in contemporary society, with the goal of promoting ethical and equitable use of this emerging technology.
